Is this government legal or not ?

This is the dilemna everyone has been talking about for a week now, but it is only Hezbollah & Aoun & our shameful president that have been trying to market this idea, knowing that it has no legal basis.

The government is legal, and whats the big deal if Shiite ministers resigned ?
we have a constitution we have to base ourselves on, not Hezbollah’s political agenda or Aoun’s crazy ambitions to determine what is legal or not.

1-The president firstly is illegal, and even if we consider he s not, cannot consider the government as an illegal or resigned one unless the government resigns and it didnt.
( Article 53 5th point from the constitution)

2- As per article 69 concerning Government Resignation:
The Government is considered resigned in the following circumstances:
a. if the Prime Minister resigns;
b. if it loses more than a third of the members specified in the Decree forming it;
c. if the Prime Minister dies;
d. at the beginning of the term of the President of the Republic;
e. at the beginning of the term of the Chamber of Deputies;
f. when it loses the confidence of the Chamber of Deputies based on the Chamber’s initiative or based on the Council’s initiative to gain the Chamber’s confidence.

None of the above points are true, so the government IS legal.

3- Can the government meet without the president’s approval ?
Yes i surely can and therefore its session was legal and the international tribunal voting was an eligible one. The Constitution (Article 69 point 6 ) which was modified in Taef allows the PM to meet without the president’s approval.

4- The argument Lahoud raises about the government being illegal (based on Article 95) given the fact that there is a community not represented and so there is no equal partition inside the government.
This is also not true since the government was appointed based on an equal partitioning.

Added to that, Lahoud argues that the government is violating the pact of Communal co-existence, a syrian appointed president who is part of a Syrian regime that has oppressed the people since 1992 elections and the 87 % boycott and who has violated the constitution to prolong his mandate is lecturing us about communal co-existence.

Berri’s arguments are empty ones as well and lack any legal backing and therefore this government is legal by all standards.

    Micho Aoun had a government of 2 ministers, all of the same color, same sect , same religion, none of them elected and same mental abilities and he consider them legal against everyone else, How come he changed his mind today ??????
    What is good for Micho is not good for everyone else ??????
    He creates laws without even being a president, imagine if this Rambo ever rules the country again !!!
